A Criminal Motion case is commenced by filing a Notice of Motion and a supporting affidavit in the High Court. It is similar to an Originating Summons case -- it is inter partes and has to be served on the opposing party. Once a Notice of Motion is filed, a hearing date will be provided by the Court.
