4 The plaintiffs let their vessel "Minghu" to the defendants on a charterparty for three voyages to carry crude palm oil in October 1990 from Kuantan to Pasir Gudang. They claimed the sum of US$129,694.33 as freight on the basis of US$6.50 per metric ton of cargo carried. The defendants admitted to only US$106,500 being due. They disputed the basis on which the plaintiffs arrived at their figure as well as the figure itself. On appeal from a summary judgment given by the Assistant Registrar in the larger sum claimed, I varied the judgment to one for the undisputed, smaller, sum. As the claim for the balance involved a dispute which could not be decided on the material before me, I gave leave to the defendants to defend it.
